If bankruptcy is not an option, we can assist in negotiating with creditors or defending against civil lawsuits. Bankruptcy Chapter 7
Chapter 7 bankruptcy is a complete liquidation. This bankruptcy provides for all general unsecured debts to be discharged (with some exceptions). If you qualify for Chapter 7 relief, you can often keep your real estate and personal property. There may be some property that is not protected and some debts that will not be discharged. Our attorneys will make sure you understand all consequences of a Chapter 7 bankruptcy before filing on your behalf.
Bankruptcy Chapter 13
There may be circumstances where you cannot file a Chapter 7 bankruptcy. When a Chapter 7 is not the right option for you, a Chapter 13 reorganization can be the better option. Chapter 13 bankruptcy is similar to a repayment plan. Chapter 13 bankruptcy allows you to repay some or all of your creditors based upon your income and property. A bankruptcy repayment plan generally lasts for up to five (5) years. Upon completion of your plan, you can obtain a discharge of any remaining balances owed pre-bankruptcy.
